まさに労働基準法が、秘書のことを「機密の事務を取り扱う者」と書いてます。
> 第41条(労働時間等に関する規定の適用除外)
> 2号
> 事業の種類にかかわらず監督若しくは管理の地位にある者または機密の事務を取り扱う者
第41条は残業・労働時間規定の除外という重要な章であるのに
未だにこの分かりづらい条文が直される気配がありません・・・。
ちなみに判例では、上記41条に該当するのは
「単なる秘書でなく、経営者と一体的な立場にある者」であると厳格に範囲を狭めてます。
よくある「管理職は残業代がつかない」というのも判例上は
「役員待遇でない中間管理職は41条に含まれず、残業代不支給は違法」なのですが
このあたりも含めて世間的に知られてないのは、この分かりづらい条文のせいじゃないかと思います。
